My issue is regarding the frequent suspension of my drivers license due to clerical error in the magistrate office of Jefferson county, wv AND due to my last ticket where I was charged with driving on a suspended license had a court date backdated two weeks prior to receiving the ticket. So I got pulled over on */*/* and cop gave me a driving on suspended fine and the court date listed on the citation was dated */*/*. I went to the magistrate office that same day on */*/* and paid $* in fines and the magistrate told me I’d be good to go, she even personally sent over the verification of satisfaction to the dmv for me due to the clerical issues that caused my suspend to begin with, so then a week later I contacted the dmv and paid the $* reinstatement fee and my license was reinstated that day on */*/*. Then on */*/* I went onto the dmv and had my drivers license renewed because it was expired. It renewed with no problem on */*/*. The dmv gave me a temporary print out of my license and said that I’d receive the actual license in the mail within *-* weeks. I never received it and I called the dmv to find out why and they said it’s due to a drivers license suspension that was sent to the dmv by the Jefferson county wv magistrate clerk in December of * requesting that my license be suspended.
Hello ****, I understand your frustration. I suggest contacting the Jefferson County Magistrate's office again to clarify this issue. You may need legal assistance to resolve these repeated errors. Do keep all your documents and receipts as evidence.
I’m asking you for legal help. I tried calling them
Thank you for providing a detailed explanation, ****. It seems like you're dealing with an administrative issue. I would recommend considering the following:
- Contact a local legal aid organization for help.
- Consult with a traffic attorney to get insight into your situation.
- File a complaint with the West Virginia Judicial Investigation Commission if it's a magistrate issue.
This is a complex issue and professional legal help would be beneficial.
My big question is about the backdated date on traffic citation
Hello ****, the backdated court date on your citation might be a clerical error. You should:
- Contact the law enforcement agency that issued the citation.
- Consult with a traffic attorney to understand the implications.
- Keep a record of this discrepancy for your records.
This situation requires legal attention to avoid potential consequences.
Why is the date provided on a traffic citation
The date on a traffic citation usually indicates when the infraction occurred. If it's backdated, like in your case, it seems like a clerical error. You should definitely bring this to the attention of the issuing authority and your attorney.
The cop said if I appear to the court date showing everything’s paid and rectified that it’ll be dropped
If the officer advised you to appear in court with proof of payment and rectification, you should follow this advice. Bring all documents proving you've paid the fines and rectified the issue. If the charges are indeed dropped, ensure you get a document confirming this.
But it was paid and the date was backdated
I understand your concern, ****. This seems like a mix-up. As recommended before:
- Report the backdated court date to the issuing authority and your attorney.
- Retain all payment proofs and communication related to this incident.
- Seek legal advice to navigate the situation.

This issue necessitates legal scrutiny.
How do I get the magistrate court to recognize that they made a mistake suspending my license
Here are steps to follow:
- Write a formal letter detailing the errors to the Jefferson County Magistrate's Court.
- Include all the relevant document copies (payment receipts, citation, etc.)
- Consult with a traffic attorney for guidance.
- If unresolved, consider filing a complaint with the West Virginia Judicial Investigation Commission.
Will the wv judicial commission handle errors made by clerks too?
Yes, the West Virginia Judicial Investigation Commission investigates allegations of misconduct or errors made by judicial officers, which include clerks. You can file a complaint with them in your situation.
Okay what about when a clerk used white out to have you change your plea from guilty to not guilty (causing you to be issued a court date) even tho you’re paying the fines that day and pled guilty hence the reason your paying the fines because if you’re not guilty then you wouldn’t pay the fines right?
In your case, you should:
- Consult with a lawyer to understand the implications of this action.
- Report this incident to the West Virginia Judicial Investigation Commission.
- Keep a record of this incident for future reference.
Remember, legal advice is crucial in such situations.
