In April of * I was referred to a Lawyer concerning my Mom's house. My mom didn't leave a will, but I was living with her at the time. My siblings all signed off on the home so I can own the home and get legal deeds. This lawyer has been giving me the run around going on 5 years and I still haven't got ownership of the home. Please advise
Hello ****, sorry to hear about your situation. In Alabama:
- The Probate Court handles the distribution of an estate when there's no will.
- Beneficiaries' approved release should expedite the transfer process.
You might consider filing a complaint against the lawyer with the Alabama State Bar if you believe there's been misconduct.
I signed all the documents she wanted me to, including the deeds form. I paid her at the time of service. Do I need to contact the Probate Court and start the process all over again. Like getting my siblings to resign the transfer process?
You may not need to start the process all over. However, you should:
- Verify with the Probate Court if the deed transfer was initiated.
- Consult a different lawyer if necessary.
- Consider filing a complaint with the Alabama State Bar, as mentioned earlier.
Thanks, I will.
You're welcome, ****! Please don't hesitate to ask if you have any more questions or need further assistance. Best of luck with resolving your situation.
