My stepfather allowed my boyfriend and I (and two little service dogs) to stay in his house rent-free until we got back on our feet after having been fired from our job (where we met), he is now evicting us with no written notice whatsoever knowing very well we don’t have the money to get ourselves a roof over our head yet, no where for our things, and no car, however we do have a way to get somewhere safe on Thursday. How can I exercise and assert my tenant rights so that we are able to stay here until Thursday?
Hello ****, sorry to hear about this tough situation. Could you please provide your location so I can provide the most accurate legal advice for your area?
Bountiful, Utah
Hello ****,
In Utah, landlords typically need to provide:
*. A *-day notice for unpaid rent.
*. A *-day notice for a lease violation.
*. A *-day notice for a monthly lease without a specific ending date.
Please consult a local attorney for personal advice.
No lease was made or signed or stated, no rent is paid, so I’m assuming *. is the correct law to abide by in this situation. He is threatening to call the cops and say we’re trespassing. What do I do?
You're correct, ****. If there's no lease or rent, the *-day notice usually applies in Utah. If the police are called, you can explain your situation, as you're not technically trespassing. Remember, it's advisable to seek legal counsel for personalized advice.
Great, thank you. What do I do as far as my fear of his harassment, and his constant breach of my privacy, entering our space at odd hours of the night and threatening us? It’s made me scared of him that he will hurt my dogs, which he had done before
I'm really sorry to hear about your situation, ****. In Utah, you may consider:
*. Filing a protective order against your stepfather if you feel threatened.
*. Reporting animal cruelty if your dogs are being harmed.
*. Documenting incidents of harassment for potential legal action.
Please consult with a local attorney for advice tailored to your specific circumstances.
What kind of protective order should I get, being that we have to share the same roof but on separate floors so we don’t run in to each other
In Utah, you may apply for a Cohabitant Abuse Protective Order. This order can prohibit him from entering your living space, disturbing your peace, and committing acts of domestic violence. It's advisable to consult with a local attorney for personalized advice.
