I have a friend who changed her mind about renting from my fiancé and I after already paying her security deposit and first months rent. She kept telling us she was going to move in but kept pushing it off. We got into a fight and she is now demanding her deposit back saying the court will rule in her favor if we do not give her the money she paid. She’s been scamming charities out of money. She told us she was “behind on her rent” and was going to get Operation Help to pay us for it KNOWING she wasn’t behind on rent. We told her we do not want to be a part of the scam. What do I do?

Hello ****, in Missouri:
- Landlords must return a security deposit within 30 days of tenant move-out.
- If the tenant didn't move in, the landlord can keep the deposit to cover lost rent.
You should consult a local attorney to handle this issue.
So because she did not move in I can keep the deposit?
Yes, generally in Missouri, if a tenant doesn't move in, the landlord can keep the deposit to cover the lost rent. However, it's always best to consult with a local attorney to fully understand your rights and potential liabilities.
