It’s for my son. He’s been arrested for child neglect. My grandson has been hospitalized apparently for malnourishment. My son has taken his son to several appointments trying to find it why his som was throwing up and loosing weight and was told it was all normal. He was trying to help his son and then got arrested for neglect
I'm sorry to hear about your situation, Michelle. Could you please tell me in which state this happened? Child neglect laws vary from state to state.
West Virginia
I'm sorry to hear about your son's situation, Michelle. In West Virginia:
- Child neglect is considered a felony.
- A person is guilty if they create a risk of injury, including malnutrition.
- The state must prove neglect was intentional.
I'd suggest contacting a local attorney for more specific guidance.
The child was given Similac advance and he kept throwing up and was taken to the pediatrician appointments and was questioned and they said it was normal. I have looked up that Similac causes side effects of vomiting and weight loss
I'm sorry to hear about your grandson's health issues. If your son followed doctor's advice and the baby's condition is due to a product, you might have a product liability case against the manufacturer. Consult with a lawyer experienced in product liability cases.
Which kind of lawyer do you suggest?
You may want to consult with a Family Law attorney for the child neglect charges and a Personal Injury attorney for the potential product liability case against the manufacturer of Similac.
Thank you.

I do have one more question. My son said when he was taken to the facility ( jail) he had hugged the mother of his child ( who was also arrested for the same thing) , an officer had grabbed him and thrown him against the wall. I result of this.. he’s having problems with his leg. My son has a metat rod in his leg due to a car accident years ago
I'm sorry to hear about your son's situation. This could potentially be a case of police misconduct. It would be best to consult with a Civil Rights attorney. They can help determine whether your son's rights were violated and if action can be taken.
