Child Support Violation Consequences

Full Conversation

my ex violated me because i didn’t pay my child support for 4 months, this was the second time he violated me on willful disobedience of the order as the first time i was in a head on collision and was in the hospital for 2 months and couldn’t walk or work for 6 months after that. since it’s my second violation and i only pay *$ a month the judge forwarded my case to civil court and is recommending 7 days in jail if i missed any payments in between. she said im not going to jail, but is there any chance they will still send me to jail even though i’ve paid all my arrears and have made every monthly payment since?

Hello Brittany,
In New York:
- Non-payment of child support can lead to jail time.
- However, if you've paid all arrears and continue making payments, it can positively influence the judge's decision.
- The intent to violate the order is considered, not just the act itself.
