My question is on my brothers behalf.
Hello, it's nice to meet you! Could you please specify the exact legal issue your brother is facing? Also, please provide the location as it can help us provide more precise information.
He was arrested in Missouri on a governors warrant from North Carolina. When he was arrested he had some meth on him. They didn't charge him for that the whole time he was in their custody. They held him in Missouri from October until January and never charged him with the meth. In January they released him to law enforcement from North Carolina. He's been in jail in North Carolina ever since. They were going to release him on a PR bond but now Missouri has a fugitive warrant out for him for failure to appear in court. He was never given a charge or a court date before now. Is that legal. Can Missouri issue a fugitive warrant even though they released him to another law enforcement agency in which he's been in the custody of since Missouri released him. They knew where he was. How can they say that he's a fugitive when they are the ones who sent him to another jail in another state?
While it's unusual, Missouri can issue a fugitive warrant under certain circumstances. Each state has its own laws and regulations. In this case, the following factors may apply:
- The Meth possession might've been part of the Governor's warrant.
- Sometimes, charges can be filed later, even after release.
- Warrants may be issued for failure to appear even if the person is in custody elsewhere.
I recommend consulting with a defense attorney in Missouri for the best advice.
Ok. Thank you
