I have tried to contact the prosecutor they don’t put me through to her and she never returns my call. I have went and signed papers saying I didn’t want to proceed w any charges. But my partner is on probation and this will be a violation. When police came there had been no domestic fight between my partner and I. She was inside reading I was working on our garage door. Police came asked if she lived there and for her to come outside so that they could talk to her. They would not tell me what the issue was. I hollered at my wife to come talk to police she wasn’t dressed so it took a few min. When she came out they said it was over a domestic disturbance call made by Steve brown who is my cousin. We was confused as we had not been in any dispute my partner had not even been outside that day. We knew Steve Brown had made no such call he doesn’t even live around here and we had not spoke to him in a few months. Even tho the police witnessed my working outside as they pulled up and my partner in the house they kept telling us we had bruises on our necks which was untrue. They would not accept that their had been no domestic between us even tho we kept insisting there had not. They then seperated us and read my partner her rights before questioning her but my rights were not read to me before question. They told us both at least one party goes to jail on any domestic report. One or both. My partner told insisted we had not been in a fight even tho they threatened her w jail. They kept telling me one or both of us and I did not want to go to jail so I made up a story about being stressed over bills and having a little scuffle. I said it wasn’t a big deal and I didn’t want to press charges. I gave them this u true story because I was pressured and coerced to give them something. I did not want to go to jail. This was untrue and I apologize for this and will cooperate to undo this. There was no domestic but police wouldn’t accept that nor would they allow us to call Steve or they call Steve to check and verify that it was or wasn’t a legit call. They wouldn’t allow us to prove a fraudulent call to them. I don’t believe the way they handled this situation was right. They had a fake call no proof and still kept pressuring for a statement to arrest. My partner was taken to jail because of my false statement that they pressured me to make.
I understand your frustration and the complexity of your situation. Here are steps you might consider to recant your statement:
- **Contact the Prosecutor in Writing:** Since phone calls haven't worked, send a detailed written statement explaining the coercion and the truth.
- **Document Everything:** Keep records of all your attempts to contact the prosecutor and any responses.
- **File a Complaint:** Consider filing a formal complaint about police conduct if you believe your rights were violated.
