I have questions regarding child support modification
It's nice to meet you, ****. I'll do my best to assist you. Could you please specify your location as child support laws vary from state to state?
West Virginia
Great, thank you for confirming your location, ****. Here are some general points about child support modification in West Virginia:
- A court can modify child support if there's a significant change in circumstances.
- This could be a change in income, job, or the needs of the child.
- You must file a motion to modify with the court.
Would you like information about where to file this motion?
I pay child support to my ex because he was paying for our son’s health insurance. He no longer pays for it and his wife, my son’s step mother picked up his health insurance without my knowledge or consent. They did not report that to the court. He also had a change in income and now makes more than he did when the child support was ordered. He also did not report that to the court. This occurred in May of this year. When we go back to court for the modification, am I able to request back payment from him due to him failing to report the changes. Assuming I will not longer owe child support, which I’m positive I will not.
In West Virginia, courts can retroactively modify child support orders from the date a motion to modify was filed. You can request back payment, but the decision is at the court's discretion. For the best outcome, consult with a family lawyer.
